Terms of Use

1. About these terms

These terms apply when you download, access, or use Spendiary. Spendiary is developed and operated by Rodrigo Bange, an individual based in the Netherlands, under the project name StabilisSoft. StabilisSoft is not a separate company or legal entity. By using the app, you agree to these terms. If you do not agree, do not use the app.

The developer’s complete contact details are provided in section 13 below.

Nothing in these terms limits consumer rights or other rights that cannot legally be limited.

2. Eligibility and personal use

You may use Spendiary only if you can legally agree to these terms in your country. Spendiary is intended for a general audience and is not directed specifically to young children. If you have not reached the age at which you may enter into this agreement or make a purchase independently in your country, a parent or legal guardian must review and authorise your use of Spendiary and any Spendiary Plus purchase.

The app is designed and licensed solely for personal and household budgeting, not for business accounts, professional bookkeeping, employer-managed records, or use on behalf of an organisation. The licence is limited, non-exclusive, and non-transferable except as permitted by the applicable app-store usage rules, including any eligible device or family-sharing rights provided by the store. Access may be restricted following a material breach only where that response is lawful, reasonable, and proportionate, without affecting mandatory rights connected to a paid purchase.

3. Your information, device, and backups

You are responsible for the accuracy of information you enter, the security of your device, and maintaining suitable backups of information that matters to you. Device failure, deletion, operating-system behaviour, corrupted or incompatible files, and changes to the app may affect locally stored information.

Automatic backups remain inside Spendiary’s app storage and may be lost together with the app or device. They are not a substitute for exporting a separate backup. I cannot retrieve information that exists only on your device.

Uninstalling Spendiary, clearing its storage, resetting or replacing your device, or losing access to your device may permanently delete locally stored information. Verify that a separate exported backup can be opened before relying on it.

Manual backup files can contain a readable copy of sensitive financial and personal information. Store and share them carefully. The Privacy Policy explains how Spendiary handles data.

4. Spendiary Plus, stores, and refunds

Purchases are processed by the Apple App Store or Google Play and are also subject to the relevant store terms. Your use of Spendiary is subject to the applicable app-store licence and usage rules. If you obtain Spendiary through the Apple App Store, Apple’s Standard Licensed Application End User License Agreement applies to the licence for the app. These Terms supplement applicable store terms and do not replace or limit them. If there is a conflict, the store terms control to the extent required for that store’s services, without limiting mandatory consumer rights.

Spendiary Plus is presented as a one-time upgrade with no recurring charge for the platform and store account used to purchase it. Availability across different platforms or unrelated store accounts is not guaranteed.

Spendiary Plus unlocks the on-device Plus features identified on the purchase screen at the time of purchase. It does not include separately offered future products or hosted services, including cloud storage, cloud sync, collaboration, web access, or a Spendiary Pro plan, unless the offer expressly says otherwise. Existing Plus features will not intentionally be removed merely to resell substantially the same functionality as a separate Pro product. This does not prevent changes reasonably necessary for security, law, supported-platform compatibility, or technical operation, subject to the rights and remedies described below.

Plus is normally supplied immediately after the relevant store confirms the purchase. Purchase verification and restoration use RevenueCat and the relevant app store.

Withdrawal and refunds

Consumers may have a statutory right to withdraw from a purchase within 14 days. For digital content supplied immediately, that right may end once supply begins only where the consumer expressly requested immediate supply and acknowledged losing the right of withdrawal. The store checkout and receipt identify the contracting seller and the applicable withdrawal route. Where Apple or Google processes the withdrawal or refund, use the procedure provided by that store; you may also contact me for assistance. Store policies do not limit any withdrawal, refund, or other remedy required by law.

Legal guarantee and remedies

Spendiary and its paid digital content must conform to the contract and perform as consumers may reasonably expect from the description, purchase screen, price, and other relevant circumstances. If they do not, consumers may be entitled to correction or an update free of charge and, where the problem cannot be resolved within a reasonable time and without significant inconvenience, an appropriate price reduction or termination and refund. Necessary security and conformity updates will be supplied for the period reasonably expected under applicable law. These legal rights are separate from any voluntary store refund policy.

To report a purchase problem or make a complaint, email [email protected] with enough information to identify the issue without sending unnecessary sensitive financial information. Complaints will be acknowledged and answered within a reasonable period, normally within 14 days. If more time is needed, you will be told when to expect a substantive response.

5. Advertising and third-party services

The free version may display banner ads and may offer an optional rewarded ad to restore an eligible missed-day streak. The reward has no cash value and is granted only when the advertising provider reports that the required viewing event was completed. Spendiary Plus removes ads. Ad availability, content, and delivery can vary, and watching a rewarded ad is optional.

Some features rely on third-party services, including the app stores, RevenueCat, Google AdMob, Sentry for minimized crash reporting and optional enhanced diagnostics, and services used to deliver support messages. You must comply with the applicable terms of Apple, Google, and other third-party services when using them. Their privacy notices also apply to their processing.

6. Acceptable use

Do not misuse Spendiary, interfere with its operation, bypass security or purchase controls, reverse engineer it where prohibited by law, attempt unauthorised access, or use it in a way that harms others or violates applicable law.

7. Ownership

Spendiary, its design, software, branding, and original content belong to its developer or licensors. These terms give you permission to use the app but do not transfer ownership of it. You keep ownership of the information and images you add.

8. Availability, updates, and ending support

Updates necessary to keep Spendiary secure and in conformity will be supplied for the period reasonably expected under applicable law. You are responsible for installing updates made available to you within a reasonable time. I am not responsible for a conformity problem caused solely by a failure to install an update if you were informed about the update, the consequences of not installing it, and the installation instructions were adequate.

Changes beyond those necessary to maintain conformity may be made only for a valid reason, such as security, legal requirements, compatibility with supported operating systems or app stores, correction of technical problems, accessibility, or adaptation to material third-party platform changes. Such changes will not impose an additional charge for existing purchased functionality.

Changes will be explained clearly. If a change to digital content supplied over a period of time has more than a minor negative effect on access or use, any advance notice on a durable medium, option to retain conforming access without the change, or right to terminate free of charge within 30 days required by applicable law will be provided.

Continuous or error-free availability cannot be guaranteed. If support for the app or a material feature is ended, reasonable advance notice will be provided where possible and as required by law. Ending support does not remove any update duty, legal guarantee, or remedy that continues to apply.

9. Warranty and liability

Spendiary is built with care, but calculations and outputs depend on the data you enter and the behaviour of your device and third-party platforms. To the extent permitted by law, its developer is not responsible for decisions made solely from app output or for loss to the extent it was caused or increased by inaccurate or incomplete user input, failure to follow clearly provided backup instructions, device or operating-system failure, or third-party services outside the developer’s reasonable control.

This does not exclude responsibility for a failure to exercise reasonable care and skill or for direct, foreseeable loss where the developer is legally responsible. Nothing in these terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any warranty, remedy, consumer right, or liability that applicable law does not allow to be excluded or limited.

10. Suspension or termination

You can stop using Spendiary at any time by uninstalling it. Future access to online services, distribution, or updates may be restricted if reasonably necessary to protect the app, users, legal rights, or third-party services, or if you materially breach these terms. Any restriction will be proportionate to the issue. Where reasonably possible, notice and an opportunity to remedy a breach will be provided, except where immediate action is required for security, legal, fraud-prevention, or third-party-platform reasons. Mandatory rights connected to a paid purchase remain unaffected.

11. Governing law

These terms are governed by Dutch law. If you are a consumer living elsewhere, you keep any mandatory protections and access to courts that the law of your country gives you.

12. Changes and severability

These terms may be updated when Spendiary, the law, or relevant services change. Material changes will be communicated clearly in the app or through another appropriate channel before they take effect and, where required, on a durable medium. The date above identifies the current version.

Changes to these terms do not retroactively reduce rights already acquired through a completed purchase unless applicable law permits it.

If one part of these terms is found invalid or unenforceable, the remaining parts continue to apply.
